By accessing or using ScanMeLast's website, speed testing tools, and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part, please do not use our Service. These Terms apply to all visitors, users, and others who access the Service.

2. Description of Service

ScanMeLast provides internet speed testing tools that measure download/upload speeds, ping, jitter, packet loss, and network stability. Our Service is designed for informational and diagnostic purposes. While we strive for accuracy, network conditions vary — results reflect real-time measurements and should not be the sole basis for critical infrastructure decisions without independent verification.

3. User Conduct & Restrictions

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws;
• Attempt to reverse engineer, modify, or disrupt our testing infrastructure;
• Run automated scripts, bots, or excessive requests that may impair Service performance;
• Misrepresent your identity or manipulate test results;
• Use ScanMeLast to harass, abuse, or harm third parties.

4. Intellectual Property

All content, trademarks, logos, and software used on ScanMeLast are property of ScanMeLast or its licensors. You may not reproduce, distribute, or create derivative works without explicit written permission. Speed test results generated are your data, but the underlying testing methodology and algorithms remain our proprietary technology.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY ACCURATE. YOUR USE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, SCANMELAST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

6. Limitation of Liability

IN NO EVENT SHALL SCANMELAST BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

7. Data Collection & Privacy

Our collection and use of personal data is governed by our Privacy Legal policy. By using the Service, you consent to such practices. Speed test results may be aggregated anonymously for performance analytics.

8. Third-Party Links & Tools

Our Service may contain links to external sites or use open-source components. We are not responsible for the content or practices of any third-party platforms. Your interactions with them are governed by their own terms.

9. Termination

We reserve the right to suspend or terminate access to the Service at our sole discretion, without notice, for conduct that violates these Terms or harms other users. You may cease using the Service at any time.

We may update these Terms from time to time. The "Last updated" date will reflect changes. Continued use after modifications constitutes acceptance of the revised Terms. Material changes will be notified via website notice.

11. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in New York County, New York.
